Sumridhi Privacy Notice

Syngenta India Private Limited along with its affiliates and subsidiaries (“we”, “us”, “our”, “Syngenta”) have developed the mobile application named “Sumridhi” (also referred to as the “App”). The App facilitates retailer engagement and loyalty program management for retailers onboarded on Syngenta’s internal platform. Users can log in using their Saksham-registered mobile number via OTP authentication. Through the App, users can scan Syngenta products to earn loyalty points, tier points, and bonus points, participate in product-specific schemes and lucky draws, and redeem earned points through multiple reward catalogues from a third-party system. Users can also view details of their Territory Manager and Market Development Officer through the App. (“Offerings”).

We respect data privacy rights and are committed to protecting Personal Data collected on the App. This privacy notice (“Privacy Notice”) sets forth how we collect, use and protect the Personal Data collected on this App.

This Privacy Notice is an electronic record drafted in compliance with applicable data protection laws of India.

1. Definition

1. “User(s)”, “you”, “your” shall include retailers of Syngenta products that use the App.
2. “Personal Data” means any data about an individual who is identifiable by or in relation to such data.

2. Personal Data Collection

We may receive Personal Data in the following ways.

1. Personal Data collected through their App: In connection with your use of the App, the User is required to share the mobile number. A one-time password (OTP) will be generated and sent to the registered mobile number. Upon completion of the OTP verification process, the User can sign into the App. , a one-time password (“OTP”) will be generated, and upon completion of the OTP verification process, the User can sign into the App. Upon sign-in the App syncs with Syngenta’s Saksham App and imports Personal Data of the User and details of the territory manager and market development officer as available in the Saksham App.

   Contact Details and Communication Preferences. As a part of the personal data, we collect, store and process your contact information to contact you through electronic communication channels, including phone calls, WhatsApp, SMS/text messages and other social media platforms as per applicable laws for the purpose of providing updates, promotional offers and other retailer communications.

2. Location Data - The App may contain functionality that collects information about your location, such as via GPS (global positioning systems), your mobile network, or Bluetooth beacon. Company may collect and use your precise (or GPS) location information collected from the App to enhance your use of the App by providing you with sessions and meetings nearby. Location information may be used to verify your location and deliver content based on your location.
3. Log Data - Company may also collect the mobile device IP address or other unique identifier (“Device Identifier”) for any mobile phone, tablet, or other device (any, a “Device”) used to access the App. A Device Identifier is automatically assigned to your Device, and our servers identify your Device by its Device Identifier.
4. Camera and Photo gallery: The App will not access your photos or camera without first getting your explicit permission. If you give us permission to access photos or your camera, Syngenta will only use images that you specifically choose to share with us. You may use the App to select the photo or photos you choose to share, but Syngenta will never import the photos you review except those you explicitly share. At any time, you can manage your Photos and Camera preferences by turning off this feature in the Device Settings of your mobile device.

3. Cookies

We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns. We also use tracking tools such as beacons, tags and scripts to collect and track information and to improve and analyze our App. You may choose to disable cookies through your browser settings.

4. Accuracy

User undertakes that he shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Data shared with us whether of its own or any third party. In the event the User is sharing any Personal Data on behalf of a third person, the User represents and warrants that he has the necessary authority to share such Personal data with the Company, obtained a written consent from such third party and the Company shall not be responsible for verifying the same. The User understands and acknowledges that such Personal Data shall be subject to the terms and conditions of this Privacy Notice.

5. Purpose and Use of Personal Data

Syngenta may use the Personal Data Syngenta obtains about you in connection with the App to:

1. Provide you with information about the event that you are attending, including via email and push notification on your mobile device;
2. Display content you post within the App to other users of the App;
3. Create and manage your online account, provide our products and services, and respond to your inquiries;
4. Communicate with you through the App, by email, or by other means;
5. Protect against and prevent fraud; unauthorized activity; and claims and other liabilities; and manage risk exposure and franchise quality;
6. Operate, evaluate, and improve our business (including by developing new products and services; managing our communications; determining the effectiveness of our advertising; analyzing our products, services, and websites; facilitating the functionality of our websites and mobile applications; and performing accounting, auditing, billing, reconciliation, and collection activities);
7. Assist third parties in the provision of products or services that you request from third parties;
8. Monitor the use of and improve our interactive assets;
9. Perform data analyses (including anonymization of personal data) to determine, among other measurements, business performance, number of registrants, channels, and app performance;
10. to provide you with a better experience when you access our App;
11. Comply with applicable legal requirements and industry standards and our policies;
12. Respond to and process inquiries, complaints, disputes; and
13. Perform auditing, research, and analysis in order to maintain, protect, and improve our services.

6. Disclosures

We do not sell, rent, share, distribute, lease or otherwise provide your Personal Data to third parties, without your prior consent. However, in the course of providing access to the App we may share your personal Data. Accordingly, you expressly give your free consent to us to disclose or share your Personal Data in the following cases:

1. Affiliates: We may provide your Personal Data to our affiliates to enable them to improve the App, provide feedback and respond to their queries.
2. Service Providers: We may share your Personal Data including PAN and bank details wherever necessary with the third-party service providers for business purposes who work with us in connection with operating the App. All such service providers are subject to stringent confidentiality restrictions consistent with this Privacy Notice.
3. Other App Users: Users may be able to view your profile within the App (which typically will contain your name and company) on a list of attendees at the meeting. The App allows users of the App (such as conference attendees and invitees) to interact with each other. All posts you make within the App (such as posting a status update, photo, or check-in) are visible to other attendees and invitees.
4. Merger or Acquisition: We may transfer your Personal Data if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the App, to a third party. Any such third party or resultant entity that receives your Personal Data shall have the right to continue to use your Personal Data in line with the purposes set out herein. In the event of such a sale or transfer, we may notify you.
5. Syngenta Apps: Personal Data collected through Sumridhi may be exported to Syngenta’s Cropwise App and Syngenta’s Saksham App, as applicable, for authorized business purposes.
6. Legal and Regulatory Authorities: We may disclose your Personal Data if we believe that we are required to do so: (i) by law; (ii) to comply with legal process or governmental requests; (iii) to enforce our agreements; (iv) to protect our operations; (v) to protect the rights, privacy, safety or property of the Company, you or others; (vi) to protect our reputation and (vii) to permit us to pursue available remedies or limit the damages that we may sustain.

7. Data Retention

We will retain Users’ Personal Data as long as it is required to be retained for the purpose of your usage of the App. We may also retain and use Users’ Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

8. Security

Your Personal Data is stored on public cloud infrastructure hosted by third party. While we implement appropriate firewalls and protections, we cannot warrant the security of Personal Data transmitted as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we will take necessary measures to mitigate such events. You are required to be careful to avoid “phishing” scams, where someone may send you an e-mail that looks like it is from us asking for your Personal Data.

9. Data Transfers

Syngenta may transfer Personal Data to countries other than the country in which the data was originally collected. Such data transfers shall be governed by applicable data protection laws subject to appropriate contractual, technical, and organizational safeguards to ensure an adequate level of protection of Personal Data.

10. Children’s Personal Data

Our App is not meant for use by any person who is under the age of 18 years without receiving explicit consent from their parents. If we learn we have collected or received Personal Data from a child without verification of parental consent, we will delete the information. 11. Your Rights

Subject to applicable law, the User shall have the following rights:

1. To access the information about Personal Data processing by the Company.
2. To request the correction, completion, updating of Personal Data or request the erasure of Personal Data.
3. To grievance redressal.
4. To nominate an individual to exercise User privacy rights, in case of death or incapacity.

Without prejudice to the above, in the event the User’s grievance is not addressed within the prescribed timelines under applicable law or to the User’s satisfaction, the User may approach the Data Protection Board of India, in accordance with the procedure prescribed under applicable law.

12. Governing Laws

This Privacy Notice shall in all respects be governed by and construed and enforced in accordance with the laws of India and the courts of Pune, India shall have exclusive jurisdiction to adjudicate any subject matter under this Privacy Notice.

13. Changes to this Notice

Please revisit this page periodically to stay aware of any changes to this Privacy Notice, which we may update from time to time. If we modify this Privacy Notice, we will make it available through the App and indicate the date of the latest revision. If such modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change via email or through our App.
